Welcome to Growing! These Terms of Use ("Terms") govern your access to and use of the Growing mobile application, web application, and related services (collectively, the "App"), operated by Utopian Adventures, LLC ("Company," "we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the App.

1. Eligibility & Account Registration

  • Age Requirement: You must be older than 13 years of age to access or use the App.

  • Accounts: You may browse certain single-session features without an account. To access persistent features, interact in public or private chats, or save data, you must register for an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

2. User-Generated Content (UGC) & Interactive Features

The App allows users to post, send, transmit, and share text, media (including photos, videos, and files), and other materials across 1-on-1 messaging, group chats, and public channels ("User-Generated Content" or "UGC").

  • Ownership: You retain ownership of the UGC you create and share. By submitting UGC to the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content solely as necessary to operate and provide the App.

  • Zero-Tolerance Policy for Objectionable Content: We strictly prohibit any form of abusive, illegal, or harmful behavior. You agree that you will NOT post, upload, transmit, or distribute any UGC that:

    • Is unlawful, defamatory, libelous, harassing, threatening, or invasive of another’s privacy.

    • Contains hate speech, promotes discrimination, or incites violence against any individual or group.

    • Contains sexually explicit, pornographic, or obscene content.

    • Infringes upon any third party’s intellectual property, privacy, or publicity rights.

    • Contains spam, viruses, or malicious software.

3. Content Moderation, Reporting, and the 24-Hour Action Rule

To maintain a safe user community, the App enforces mandatory safety controls in strict compliance with App Store guidelines:

  • In-App Safety Controls: The App provides built-in mechanisms on all UGC items, posts, messages, and user profiles enabling users to flag/report objectionable content and block abusive users.

  • 24-Hour Review & Action Window: We actively monitor and review all flagged items. We commit to reviewing reported UGC and taking action on valid reports within 24 hours of submission.

  • Enforcement & Termination: We reserve the right, in our sole discretion, to immediately remove or disable access to any UGC and to suspend or permanently terminate any user account found violating our Zero-Tolerance Policy, without prior notice.

4. Intellectual Property

The App, including its source code, design, logos, brand elements, and features (excluding your raw UGC), is owned by Utopian Adventures, LLC and protected by copyright, trademark, and other applicable intellectual property laws.

5. Disclaimer of Warranties & Limitation of Liability

  • "AS IS" Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

  • Limitation of Liability: To the fullest extent permitted by applicable law, Utopian Adventures, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App, including any unauthorized access or third-party UGC.

6. Indemnification

You agree to defend, indemnify, and hold harmless Utopian Adventures, LLC, its officers, members, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms or your UGC.

7. Governing Law & Dispute Resolution

These Terms and any legal disputes or claims arising out of or related to the App shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Florida.

8. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify users of changes by posting the updated Terms on this page with a revised "Effective Date." Continued use of the App after updates constitutes acceptance of the modified Terms.
